DAY 305 - DID HE RESIGN TO RUN?

Chairman Marc David Sarnoff, who is in a lot of deep hot water as of late, first came to prominence as the Chairman of the Coconut Grove Village Council.

According to their website, the "Coconut Grove Village Council is an elected body consisting of nine representatives."

In Florida, there is a law called "Resign to Run."

Basically:

The “resign-to-run law” essentially prohibits an elected or appointed “officer” from qualifying as a candidate for another state, district, county or municipal public office if the terms or any part of the terms overlap with each other if the person did not resign from the office the person presently holds. (Section 99.012(3), Florida Statutes.)

Sarnoff was elected to the Village Council in 2005.

So he was ON the Council in November 2006 when he ran for the City of Miami district 2 Commission seat.

Is this a violation of the Resign to Run law?

We already know Chairman Sarnoff thinks laws don't apply to him.

And we know first hand what he is capable of.

But it's catching up...

Fantastic point. Also, did he properly qualify to run for office, or should his qualification to run be voided? The documents he used for his "proof of residency" in District 2 in the qualifying documents package listed his residence address as 3000 Shipping. He did not live at 3000 Shipping. That was his business address in 2006 and 2007, not his residence.

What would have happened had Sarnoff lost, would he have kept his seat on the Village Council? Why didn't he resign like he was supposed to? At the very least it creates the appearance of impropriety that he always says he wants others to avoid.

If MFC was threatened with legal action by the city or a commissioner is the document public record? If a commissioner had a law firm send the letter on his behalf, did he pay for the legal help?

See Section 4 C of the Charter:

No mayor, city commissioner, or other officer or employee of said city shall accept any frank, free ticket, pass or service directly or indirectly, from any person, firm or corporation upon terms more favorable than are granted to the public generally. Any violation of the provisions of this section shall be a misdemeanor.

I do not think the resign to run law, F.S. 99.012, applies to a board member of the Cocoanut Grove Village Council, Inc.

Membership on the board is not a "public office" as the council is a independent nonprofit corporation; and board members have not been delegated the authority to exercise municipal power by a municipal officer.

He is still creepy.

The Coconut Grove Village Council is established as a non-profit organization ( 501c(4) ). That is why we are not subject to Sunshine Laws or Resign to Run, etc.

The city is planning to turn all of downtown into a massive block party for the Miami Heat on opening night, creating a hype to match the hype of Dwyane Wade, LeBron James and Chris Bosh on the basketball court.

THE CITY IS PUMPING MAD MONEY INTO THE EFFORT, which involves cleaning up the streets to have an NBA shine by the time the first home game rolls around Oct. 29.

"We are so excited about the heat season starting we are going to throw a big tailgate party on Biscayne Boulevard," said Alyce Robertson, executive director of the Downtown Development Authority. "We are working with the Heat organization to be able to project the whole game outside and get the dancers outside as well as the entertainment that's going on inside come outside to the street party."

That's right. The plan is to turn downtown Miami into a massive party.

Restaurants are being courted to line Biscayne Blvd. Big screens set outside so that everyone, not just the lucky ticket holders inside, can see the first home match up against in-state rival, the Orlando Magic.

But it's never too early to plan for a designated driver or a massive traffic nightmare.

Biscayne will be closed in front of the American Airlines Arena from N.E. 6th Street to N.E. 8th. It's estimated 11,000 people can stand in front of the arena, so they need room for more.

Organizers will likely use the amphitheater at Bayfront Park or Bicentennial Park to handle the overflow crowd.

There is a significant effort to fix up downtown for all the international visitors and locals.

"We are cleaning up and trying to fix the parking lots and to trying to get it all ready for the block party for the first game here in Miami," Mayor Tomas Regalado said.

God forbid there should be this kind of a city effort to clean streets in Overtown. An area that, unike the arena, is actually within the CRA. But Dunn has no clue. Where is Spence-Jones?

AL when submitting your ethics complaint , be sure to also submit it to the State's ethics board.
We all know that the County's ethics board is powerless.ANd isn't it time that we start waking up the state's anticorruption folks for a trip to Miami?

This is just outright disgusting. This is a middle finger from Tomass and the rest of the commission to the citizens of Miami. You know the little peoples that they are looking out for. How much is this going to cost the taxpayers by having police, Fire rescue, and solid waste to clean up after the event. And lets not even get into the Big screens, lane shutdowns, and personnel to assist the citizens. These people are just outright criminals.

Sending city funds on the Heat is nothing new.

Read the new Times article of 5/23/96, "A Little Friendly Persuasion" relating how the Herald's Tony Ridder refused public records requests while, he negotiated on behalf of Miami-Dade County, the City of Miami, and the City's MESA, to build Arison a new arena. (Former Herald publisher Dick Capen was sitting on the Heat board).

Or read the New Times article of 5/2/96, "Micky Arison Is a Greedy Corporate Pig . . . and Other Observations About Backroom Politics and Big-Time Sports"

Spending CRA redevelopment funds on Arison's Heat is business as usual.

Oh, and the arena doesn't pay property taxes and all of Arison's ships are registered in foreign countries.

Tomas Regalado and commissioners will get million dollar plus pensions. Starting at age 55. They contributed nothing.
Taxpayers pay every cent.

Manny Diaz wasted $100 mil of the City's reserves and left the City with massive deficits. He is taking a pension of $100,000+ per year. Jerk.
