DEAR TONY: SUSPEND VELDORA ARTHUR NOW!

The following email was sent by a loyal TBM reader to the City Manager along with the Mayor, City Commissioners, and our pals at The Miami Herald Mayor's Press Office.
Dear Mr. Crapp:

I am outraged by the statement to the Miami Herald of Miami Fire Department spokesman Ignatius Carroll regarding the federal indictment of Assistant Fire Chief Veldora Arthur, to wit:  "Our stance is this is a personal matter that has nothing to do with her role as a fire chief. So right now she has to report to work. She’s innocent until proven guilty.”

Mr. Carroll's statement is in contradiction to the City of Miami's APM 2-98 "Relief of Duty" which states in pertinent part that:

"In the event an employee is under a criminal investigation, said employee shall be relieved of duty with pay until convicted or criminally charged, unless, as determined by the City Manager the arresting charges are significant enough to warrant the employee to be immediately relieved of duty without pay. Once charged criminally the employee shall be carried without pay."  (emphasis mine)

It is your duty as City Manager to make sure the APMs are adhered to and this case should be no different.  Ms. Arthur has, according to the Miami Herald, "been charged along with four others by a federal grand jury with taking part in an $11 million mortgage fraud scheme." 

Unless you as City Manager determine that being charged by a federal grand jury of participating in an $11 million mortgage fraud scheme is insignificant, there is no reason why Ms. Arthur is not immediately relived of her duty without pay. 

Failure to act on your part not only violates the APMs and your duty as City Manager, but further violates the bond of service between yourself and the citizens that you have sworn to serve, causing a further erosion of trust between the people and city government.

I ask that in the name of all citizens of Miami, you relieve Ms. Arthur from her post without pay.  Failure to do so will force me to seek redress from the Governor of the State of Florida.


We agree!

Tony, is it not enough that she makes $300,000 and has other jobs?  Stop the lies and the abuse of taxpayers and get rid of Veldora Arthur now!!!

THE STRAW BUYER SCOOPS ALL LOCAL MEDIA - BLOGS ARE REPORTING WHAT THEY WON'T

The Straw Buyer broke the news that City of Miami Assistant Fire Chief Veldora Arthur was indicted on mortgage fraud.

Had it not been for The Straw Buyer, the local media would not have covered this story.

Once again, blogs like ours, Al Crespo, The Straw Buyer, and others are reporting what the local news media will not.

Veldora makes a $184,000 salary and has a compensation package in excess of $300,000.

Best think about it?  She gets to keep her job!

What would happen to you in the private sector if you are served with a federal indictment?

And why should Ms. Arthur be any different than any of the City of Miami commissioners that were removed from office under indictment?

That Ms. Arthur is not put on IMMEDIATE suspension without pay is a sign that the City of Miami does not care about taxpayers, but protects its $300,000 own.

MORE ACCUSATIONS, AND THE PRESS OFFICE REMAINS SILENT

Once again, former Mayor Joe Carollo goes on Spanish language TV and blasts current Mayor Tomas Regalado for taking money from gambling machine operators.

If you do not speak Spanish, you are screwed, because the Miami Herald Mayor's Press Office WILL NOT publish this story!

Carollo reveals the names of those behind gambling machines in Miami and Hialeah, going as far as to state that these interests were involved in meetings at the City of Miami where Mayor Regalado assembled a team of city bureaucrats to discuss ways to implement the gambling machine ordinance.

One of the men involved with the machines and present at the City meeting, Jesus Abreu, has prior arrests for gambling machine violations, and the arresting officer was none other than City of Miami Police Chief, Miguel Exposito.

Could this be yet another reason why Regalado wants Exposito gone?

Carollo reiterates that he IS NOT running for office, but that Regalado's son IS RUNNING for State Representative...

Carollo also addresses allegations that he is working for Magic City Casino, and refutes those allegations.

In fact, Carollo then goes on to say that our pal Angel Zayon (who is paid over $100,000 in salary and benefits), has a T.V. show from 8 to 9 am, whose main sponsor is the Magic City Casino.  The show was given to him because Zayon is Regalado's spokesman.

The sponsorship from Miami City Casino is a payback to Regalado for protection from noise ordinance and other violations.

Carollo finishes with an analysis of Regalados' campaign reports where irregularities appear, with close to $40,000 unaccounted for.

Carollo says Regalado is immune because he controls the press through his contacts, Zayon and the Phantom Mayor Gutierrez, and he has the State Attorney quiet also.

Carollo finishes with a challenge to Regalado, to debate him anywhere!

Of course, NO ONE in the Miami Herald will report this...

Tell your readers that Joe Carollo accused lobbyist Armando Gutierrez by name of being the real man behind the power in Miami.

Tell your readers that Carollo went as far as to call Armando Gutierrez "The Phantom Mayor" who makes all the decisions at City Hall.

JOE CAROLLO TAKES ON REGALADO: SPANISH LANGUAGE HERALD REPORTS, MAYOR'S PRESS OFFICE IGNORES

The Miami Herald Mayor's Press Office has decided that if you do not speak Spanish, you should not have access to any bad news on Mayor Tomas Regalado.

Twice last week, the Spanish language "El Nuevo Herald" published articles detailing an ongoing feud between Mayor Regalado and Former Mayor Joe Carollo.

The feud started when Former Mayor Carollo appeared on the Channel 41 TV program of record "A Mano Limpia" and accused Mayor Regalado of accepting money and bribes from organized crime elements that want to introduce gambling machines into the city.

We reported on these allegations last month, but now Former Mayor Carollo has come out in public to make the accusations.

El Nuevo Herald reports both that Mayor Carollo accuses Regalado of corruption and Regalado denies the accusations.

And yet, NOT A SINGLE ARTICLE from The Miami Herald Mayor's Press Office, or the Mayor's Personal Press Secretary Chuck Rabin.

If a former mayor accuses the current mayor of taking bribes, is this not a news story?

Not to Rabin!

IF THE PRESS OFFICE CAN'T GET MAYOR'S PHONE RECORDS, WHAT ABOUT THE REST OF US?

He promised the most open, transparent, and accountable administration in City History.

But first came the gag order on all city employees.

And now, the Miami Herald is suing Mayor Tomas Regalado to obtain his phone records.

We all know how chummy the Mayor has been with the Herald, including his own personal press secretary Chuck Rabin continually writing glowing reviews of the worst Mayor in Miami's history.

So what does it say about Mayor Regalado when even his friends at the Herald can't get information from him?

How can the regular citizen get access to public information when the Mayor won't answer to the Herald?

This case is quite simple really. 

Regalado skirts public records laws by having a "personal" cell phone.  He is paid a "cell phone allowance" of $300 a month, a figure we all pay as taxpayers.  But he is able to avoid public records requests.

This conduct violates the Sunshine Laws, in letter and spirit, showing us what type of "open" and "transparent" politician Tomas Regalado really is.

"Bru stressed Monday that Regalado was willing to turn over the records, but she advised against it because she thinks it would set a poor precedent."

BULLSHIT!

Like always, Tomas wants it both ways.

If he really wants a "personal" cell phone, he can always turn down the incredibly generous $300 a month/$3,600 a year phone allowance and pay for his own damned cell phone.

Turn the records over Tomas!

THE ONGOING CRISIS SHOWS: TONY, YOU ARE NO LEADER!

$185,000 base salary.

$800 monthly car allowance.

$200 cell phone allowance.

And for what?

The man that the Miami Herald Mayor's Press Office described as:

"a people person"

"a deft problem-solver"

Someone that spent "more than a decade at Mayor Tomás Regalado's side, where he picked up a few things that go a long way in City Hall: a deft political touch, a preference for fixing potholes over drafting grand plans."

"I do understand more than people think,'' Crapp said with a smile.

Like what exactly? 

How to make nearly $200,000 a year without making decisions?

In this ongoing crisis, Tony Crapp has shown he is not a leader.

Woefully under-qualified to be city manager, Crapp continues to tread water while political sharks swim around him.

Unable to decide what to do about Chief Exposito's future, Crapp is spending taxpayer money on a consultant, prolonging the evident and inevitable.

So what will happen when budget time rolls around the real heavy difficult decisions have to be made?

From a man who has very "little finance background" who will he rely on?  Larry Spring?

Let us not forget, "this is not a metropolis..."

"Tony knows who and how long it takes to fix a pothole by public works, he knows about tree trimming, he knows how long it takes to replace a garbage can,'' Regalado said. ``We have a very good chemistry.''

But can Tony fire the police chief?  Can he make the tough decisions to balance a budget?

Obviously not.

Martin Luther King dreamed that people would "not be judged by the color of their skin but by the content of their character..."

But in Miami, the truth is evident:

Mayor Regalado hired Crapp not because of his qualifications or character, but purely on the color of his skin.

WEEKEND THOUGHT: WHAT IF...?

Let's roll back the clock a few years:

What if the Chief had accused the Mayor of obstructing an ongoing criminal investigation?

Would the Herald stay silent?

Would Jim DeFede have something to say?  What about Gary Nelson?

What if the City of Miami Police had three questionable shootings? What about Four? Five? Six?

How many shootings before the press and all the "activists" (Grace and Elvis, Harry, Brothers of the Same Mind, all the various "Reverends," Max Rameau, Denise Perry, and all the rest) would have a daily call for the Chief's resignation?

What if the Mayor had said that "violence will be responded to with violence?"

What if Joe Arriola or Pete Hernandez hired an outside consultant at $70,000 to advise him on police matters because by their own admission, they know nothing about police work?

Would a certain commissioner from Flagami vociferously object to the hiring of the consultant?  Would the commissioner from Flagami object to any of this?

What if Arriola or Hernandez sat on their hands, playing Hamlet and not making a decision, while the City of Miami Police continued to crumble under infighting?

What if the Chief and Mayor engaged in a public feud?

Would the Fraternal Order of Police back the Mayor?

So what's the difference?

FIVE QUESTIONS FOR TONY CRAPP JR.

Inspired by Al Crespo's excellent editorial in the Crespo Gram Report, and by the Mayor's Press Office editorial telling all the crazy kids to "cool it..."

Here are five questions for City Manager Tony Crapp, Jr.:

1.   Given the Mayor's open and constant criticism of the past administration for hiring and relying on too many "consultants..."

Why did you hire a "consultant" Mr. Paul Philip at $70,000 the U.S. Department of Justice or the Florida Department of Law Enforcement can conduct a patterns and policy review of the police department for free?

2.   If Chief Miguel Exposito does retire, will Mr. Philip remain in your employ?  If so, why?  If not, why not?

3.    What is the penalty for violating City of Miami APM 11-01 Media Relations Policy? 

Both Chief Exposito and Major Alfredo Alvarez have appeared on Spanish language television to support their position.  Were they authorized to do so?  If not, will they be penalized? 

What about Police Union President Armando Aguilera?  Does he need permission to speak to the press?  If not, why not?

4.     Can you explain why after several police shootings during the Summer of Violence, your former boss, Mayor Tomas Regalado "fully supported" the Police Chief, going so far as to say that "violence will be responded to with violence," but now the Mayor says the Chief must go? 

What reasons has the Mayor articulated to you as to why Chief Exposito should resign or be fired?

And finally...

5.     So what's on the video Tony?  Is it you with another woman?  You with TWO women?  A kid? A billy goat?  What's on the video???

WHY THE DOUBLE CROSS?

The Miami Herald Mayor's Press Office today has yet another article on Chief Exposito, this time stating how the "Drumbeat grows for Exit of Miami police chief."

The last two lines:

For his part Regalado, who endorsed the hiring of Exposito, said his mind is made up.

"It's toxic for the city and the image of the city,'' the mayor said. ``It would greatly benefit the city if there were an elegant exit.''

Never-mind that Regalado only cares about the "image" of the city Forbes Magazine has called second most miserable in America (citing among other things rampant political corruption as a cause).

What we find utterly incomprehensible is why Chuck Rabin won't ask the most obvious question:

Why the double cross???

Only in August of last year, at the height of the Summer of Violence did the Herald editorial board state:

"Mayor Tomás Regalado has defended the recent incidents even before investigations are complete. That doesn't help his credibility. Neither do some of his public statements, such as 'violence is met with violence.' To earn trust in neighborhoods besieged by crime, the mayor should reserve such comments."

It was Regalado who defended and was the head cheerleader for the "hunters" and "predator" attitude exhibited by the Miami police, the same attitude that claimed six lives.

But now he wants the Chief to make an "elegant" exit?

What happened since August of last year to cause this complete change of heart?

Why the double cross Tomas?

EXPO AND ALVAREZ DROP BOMBS ON SPANISH LANGUAGE TV

Chief Exposito and head of internal affairs Major Alfredo Alvarez took to the Spanish language airwaves to explain and defend themselves from the decision of City Manager Tony Crapp Jr. to name Paul Philip as a Special Adviser on Public Safety.

Chief Expo reiterates that the city charter only allows for the City Manager to be his direct supervisor.

But it was Alvarez who provided most of the fireworks during the interview stating that:
Channels 23 and 7 were the only two outlets to report about the nightclub incident involving the daughter of the Chief's executive assistant that happened in September of last year.
Dianne Fernandez, Channel 7 news reporter, stated how the police department started an investigation into this matter after she reported on the story, but that this is false because the police were already investigating.
Dianne Fernandez was told about Paul Philip being appointed before City of Miami police did.

Mayor Tomas Regalado stated to Univision that Paul Philip was brought in to supervise Chief Exposito, to investigate all the allegations against the Chief, and to make a decision as to the Chief's future because Tony Crapp Jr. is not qualified to make that decision.
Dianne Fernandez is close friends with both Tommy and Raquelita Regalado.  They live on Brickell Key, go to parties together, and it was she who reported on the anonymous allegations against the Chief.  Alvarez asks why did the five officers go to Fernandez when they could have gone to the FBI or FDLE or the State Attorney.
The costs surrounding security for the Channel 23 and Univision sponsored "Three Kings Parade" would be over $85,000, not found in the city budget, but that the police was told the city would absorb the cost.  Univision, a private company, benefited from the $85,000 security subsidy paid for by the city.  But who approved the spending of this money?
Cops anonymously going to media outlets controlled by certain factions is an attempt to make the Chief of Police look bad.
Philip is being paid $70,000 by a city that is bankrupt.
Alvarez then takes it a step further by referring to Philip's job as a "botella," a derogatory Spanish term for a hack given a government job out of convenience rather than talent.

We are anxious to see whether Babysitter in Chief Mr. Philip will ask both Chief Exposito and Major Alvarez for explanations regarding their statements.

We are also anxious to see whether the City Manager will enforce his newly created APM 11-01 Media Relations Policy, if Chief Exposito and Major Alvarez did in fact appear on camera without asking for prior persmission.

HOW MUCH DOES PHILIP MAKE? DEPENDS ON WHO YOU ASK.

So who do you believe?

Maybe it's because we've been around too long, we have seen every play from the Armando Gutierrez playbook, so we know how this is all unraveling.

Tomas Regalado needs cover.

Tony Crapp needs cover too.

For whatever reason, neither of them will not or cannot fire Chief Miguel Exposito. 

So the next best thing? 

Hire a "flak catcher" to take the hits, pay him to get blamed.

Paul Philip is a professional flak catcher.

WHY PAY FOR SOMETHING WHEN YOU CAN GET IT FOR FREE?  TO GET THE CONCLUSION YOU WANT.

Back in ancient history when Manny Diaz began his administration, the City of Police was under fire for improper shootings.

After removing former Chief Raul Martinez, Mayor Diaz invited the U.S. Department of Justice to perform a patterns and procedure review on the police.  Together with those recommendations, Chief John Timoney used his police expertise to implement the most progressive police shooting policy in the nation, going nearly two years without a shot fired.

Best of all?  It was done for FREE.

The Florida Department of Law Enforcement will also, for FREE, review your police department and provide recommendations.

So why pay a "consultant" when the DOJ or the FDLE will do it for free?

Easy!

Both the DOJ and FDLE are independent from the control of the City.

Paul Philip is not independent, he knows who signs his checks and it's Manager Crapp.

The conclusion is already determined, Philip just has to find a way to get there.


EXPOSITO HAS DONE MORE THAN ENOUGH TO GET FIRED

Regalado and Crapp are postponing the inevitable.

Back during the Summer of Violence, we along with many others called for Exposito's ouster.  Yet, Mayor Regalado stood by him.

It was when Exposito pissed off Regalado's Godson, and caught Regalado with his hands down the pants of the gambling industry, Regalado's tune changed.

Regalado and Crapp have enough reason to fire Exposito, but have chosen not to.

The Miami Herald Mayor's Press Office continues the drips of negative press against Chief Exposito.

And today's Miami New Times gives us a nutshell of Exposito's many misgivings. 

But why won't they ask the most obvious question?

We all know that Chief Exposito is a lying, cheating, conniving, corrupt, dirty bastard...

So why won't Regalado or Crapp fire him???
